Sale terms

1. General

The supply of products to the customer shall be governed by these terms and conditions of sale, which override any differing conditions on the buyers order form or other documentation.

2. Payment

Unless otherwise agreed or negotiated with an individual customer, the customer shall pay any invoice rendered by Pegasus Chemicals Limited within 30 days of its date. If the customer wishes to query an invoice, it shall raise an objection before the expiry of 15 days from the date of the relevant invoice.

3. Price variation

The price charged will be that ruling on the date of dispatch and will be subject to Value Added Tax or other government duty of tax as applicable.

4. Conditions and Warranties

Pegasus Chemicals Limited warrants that the purity of the product is not less than that laid down in the relevant standards. Whilst any recommendation relating to the use of the products made by Pegasus Chemicals Limited in it’s technical literature or in response to a specific enquiry or otherwise given in good faith, it is for the customer to satisfy itself that the products are suitable for the purpose for which it intends to use them. In no circumstances shall Pegasus Chemicals’ liability to the customer extend to the customers loss of profits, loss of use, or any other consequential or economic losses.

5. Delivery

Dates given for dispatch or delivery are approximate. If Pegasus Chemicals Limited is prevented from manufacturing or distributing the products by normal means through circumstances beyond it’s reasonable control (which includes industrial disputes, accidents and breakdown of plant and machinery) it may, without liability, cancel or delay deliveries or reduce the quantities delivered during the period it is affected by such circumstances.

6. Packaging

The receiver (customer) accepts responsibility of safe transportation of containers for refill, in the correct packaging relative to the hazard classification and transport regulations.

When a container is purchased through Pegasus Chemicals Limited, the customer then becomes responsible for all additional charges related to that container to ensure that it is fit for use.

7. Health and Safety

Each customer should be in possession of literature relating to the safe handling of any chemicals used on their site, which can be supplied by the relevant authorities. Pegasus Chemicals can offer advice on safe handling of chemicals that they supply.

8. Law

These terms and conditions are governed by English Law.
